This website is operated by Meining. Throughout the site, the terms “we”, “us” and “our” refer to Meining. The following terms govern your use of and/or purchase of products from the website.

This website is hosted on Cargo.site, a publishing platform that allows us the digital and e-commerce tools to offer our products to you. Stripe, Inc. is the third-party payment processor we use when taking an order, receiving and inspecting your shipping and billing address or invoicing your bank or credit card number. Pop Out Inc. DBA Shippo is the third-party shipping platform we use to determine couriers and shipment rates when fulfilling an order. By using our service, you will be subject to and should also review any Stripe Inc. terms of use and related policies.

Please be advised that your use of the website constitutes your agreement to follow and be bound by all of the following terms and conditions (“Terms of Service”, “Terms”, “Agreement”), including any additional terms, conditions, and policies referenced on the website or available by hyperlink.

General

We reserve the right to update any and all Terms, with or without notice. Such decisions will be published on this page upon decision. Any subsequent use of the site following the publishing of these updates constitutes your acceptance and compliance to the updates.

We reserve the right to refuse service to anyone for any reason at any time. Use of the site is contingent upon your Agreement that any information we receive (not including bank or credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Bank or credit card information is always encrypted in online transfers.

Transactions and communications over the website are unique and private to you and Meining. You may not reproduce, publish, distribute, modify, sell, or exploit in any way, any part of the Service, use of the Service, or access to the Service.

Accuracy

We promise to do our best in providing the utmost accuracy in all the information on this site. Being that Meining is a small, independent label with minimal team and support, information on the website may occasionally be inaccurate, incomplete or out of date. All products, including its specifications, descriptions and prices on the website are subject to change at any time without notice. We do not warrant the accuracy or completeness of any information, content or materials provided through the website. Any reliance on the contents of this website is at your own risk.

The inclusion of any products or Services at a particular time does not imply or guarantee its existence and availability at any time. We reserve the right to discontinue any product at any time.

Third-Party Links

Our Service relies on third-party services Cargo and Stripe for e-commerce. In addition, our Service relies on Shippo for processing shipments. Certain links from Cargo or Stripe on the Site may direct you to third-party websites that are not affiliated with Meining. We do not warrant and will not have any liability or responsibility for any third-party materials, contents, products or services of third-party websites.

Payment

You agree to pay all fees or charges to your order in accordance with the Terms at the time a fee or charge is due and payable. You must provide a valid credit card, Paypal account or Apple Pay to Stripe, our third-party Payment Provider (“Payment Provider”), to secure an order, purchase or to use certain Services. By providing to Stripe, on behalf of Meining, your bank or credit card number and associated payment information, you agree that Meining is authorized to immediately invoice your account for all fees and charges due and payable to Meining. You agree to promptly notify Meining of any changes in payment information provided for an order, so that we can complete transactions and contact you as needed.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer name, same credit card, and/or orders using the same billing and/or shipping address. In the event that we amend or cancel an order, we may attempt to notify you by contacting the e-mail and/or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that we suspect are placed by dealers, resellers or distributors.

Returns and Refunds

All sales are final. We do not take returns. If you have a damaged item, please email or DM Meining with a photo. We will work with you on assessing the item. If we agree on the damage, we will issue you a refund and send you a return label for you to return your item to us. Products are limited or made-to-order, so we cannot process exchanges. We reserve the right to deny refunds on items damaged during the process of shipping and delivery.

Shipping

Limited Edition products will be processed and shipped within 3-5 business days after you order. Please be advised and allow 4 weeks for Made-to-Order products to be made then shipped. Meining will use reasonable efforts to meet these shipment standards. However, these shipment standards are mere estimates provided by Meining and should not be relied upon entirely. All items will be shipped by Meining, in our standard packaging, using the delivery service recommended by our third-party shipping processor Shippo.

Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

For any unlawful purpose;
To solicit others to perform or participate in any unlawful acts;
To violate any international, federal, provincial or state regulations, rules, law, or local ordinances;
To infringe upon or violate our intellectual property rights or the intellectual property rights of others;
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
To submit false or misleading information;
To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect that functionality or operation of the Service or any related website, other websites, or the internet;
To collect or track the personal information of others;
To spam, phish, pharm, pretext, spider, crawl, or scrape;
For any obscene or immoral purpose; or
To interfere with or circumvent the security features of the Service or any related website, other websites, or the internet.

We reserve the right to terminate your use of the Service or any related website for violation of any of the prohibited uses.

Indemnification

You agree to defend, indemnify and hold harmless Meining and our affiliates, partners, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees, harmless from against any and all claims, damages, costs and expenses, including attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of the third-party.

Severability

If any provision of Meining’s Terms and Conditions is held unlawful, invalid, void or unenforceable, that part shall be construed, as nearly as possible, to the original intentions of the involved parties, and severed from the remaining provisions, which will remain in full effect.

Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms of Service does not constitute a waiver of such right or provision.

This Agreement constitutes an understanding between you and Meining and govern your use of Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral, written or digital, between you and Meining (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

Governing Law

This Terms of Service and this Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to any conflict of law provisions. You agree to bring any dispute arising under this agreement exclusively to the state and federal courts of the State of California in Los Angeles County.

Termination

This agreement is effective unless and until terminated by Meining. Meining may terminate this agreement at any time, without notice. Failure to comply with this agreement will result in terminating your access to the Site and our Service.

Upon any termination of this agreement, you must promptly destroy all materials downloaded or otherwise obtained from the Site, as well as all copies of such materials, whether made under these Terms of Service, this Agreement or otherwise.
